Terms And Conditions
These are the master terms for Suburban Australia and its four websites. The common terms apply to every site, together with the schedule for the service you use and any accepted quote, proposal or written agreement.
1. Who We Are And When These Terms Apply
Suburban Australia (ABN 24 550 297 597) operates suburbanau.com, Suburban Secure at suburbansecure.au, Townsville Computer Man at tsvcomputerman.com.au, and Can They Email As Me? at cantheyemailasme.com. References to “we”, “us” and “our” mean Suburban Australia, including the relevant trading brand.
These terms apply when you visit one of those websites, submit an enquiry or booking, create an account, use an online tool, buy a product, or ask us to provide a service. The common terms below apply in every case. The applicable service schedule later in this document adds terms for the particular brand or service you use.
If an accepted quote, proposal, engagement letter or other written agreement conflicts with these website terms, the written agreement takes priority for that work to the extent of the conflict. Rights that cannot lawfully be excluded continue to apply.
2. Website Information And Automated Output
Website content, articles, calculators, scans, reports, explanations and other automated output are general information based on the information available at the time. They are not legal, privacy, compliance, financial or other regulated professional advice, and are not a complete cyber security assessment, penetration test or guarantee about a device, system, domain or organisation.
You should consider your own circumstances and obtain appropriate advice before relying on website information or making material technology, security, DNS, repair, purchasing or business decisions.
3. Enquiries, Bookings, Quotes And Agreements
An enquiry, booking request, account registration or automated result does not by itself require us to accept work or create a client or adviser relationship. Work begins when scope, price and any important assumptions are accepted, or when we otherwise confirm that we have accepted the engagement.
Quotes and proposals are based on the information reasonably available at the time. If the scope, condition, dependencies or information changes, we may pause and obtain approval for a revised scope or price before continuing.
4. Your Responsibilities
You must provide information that is accurate to the best of your knowledge, identify important deadlines or constraints, keep account credentials secure, maintain lawful authority for systems or data you ask us to access, and review recommendations and approvals before they are implemented.
Unless we expressly agree to perform and verify a backup, you remain responsible for maintaining current recoverable backups of important data before repair, migration, configuration or implementation work. You must not provide access to unlawful material or ask us to act unlawfully or outside your authority.
5. Third-Party Products And Services
Our websites and services may use, recommend, detect or link to third-party products and platforms, including hosting, cloud, software, hardware, booking, payment, analytics, security, DNS, email and communications services.
Third-party products and services remain subject to their own pricing, licensing, availability, warranties, terms, privacy practices, changes and support arrangements. Unless expressly agreed in writing, we do not control and are not responsible for a third party’s service, decision, outage or failure. A reference or link does not imply endorsement.
6. Availability, Changes And Fair Use
Websites and online features are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, a particular response or completion time, permanent retention, error-free content, alert delivery or compatibility with every system.
We may maintain, change, limit, suspend or withdraw a website or feature where reasonably required for security, legal compliance, third-party changes, maintenance or fair operation. Reasonable rate limits, quotas and abuse controls may apply to online services. Where practical, we will give affected customers reasonable notice of a material change to a paid ongoing service.
7. Security And No Guarantee Of Outcomes
Technology and security risk can be reduced but not eliminated. Recommendations and work are based on the agreed scope and evidence reasonably available at the time. No result or service guarantees immunity from outage, compromise, spoofing, phishing, misconfiguration, email-delivery problems, hardware failure, data loss or third-party failure.
A favourable scan, successful repair or completed project only addresses the work and evidence described. It must not be treated as proof that every fault or risk has been identified or that future problems cannot occur.
8. Fees, Payment And Ongoing Services
Prices, deposits, payment stages, subscription periods and inclusions are those shown in the applicable quote, listing or checkout. Unless stated otherwise, recurring services continue for the displayed billing period until cancelled in accordance with the applicable service terms.
You remain responsible for fees properly incurred before cancellation or account deletion. We may pause paid work or ongoing services for overdue amounts after reasonable notice, except where a genuine invoice dispute is being addressed in good faith.
9. Intellectual Property And Permitted Use
Website text, software interfaces, diagrams, branding, templates and downloadable materials remain the property of Suburban Australia or their respective licensors unless stated otherwise.
You may use reports and deliverables supplied to you for their intended internal, advisory or customer-support purpose. You must not misrepresent, resell, mirror, republish in bulk or commercially exploit our website, tools or materials, or remove source and limitation notices, without permission.
10. Privacy
Our Privacy Policy explains how Suburban Australia handles information across its brands and websites. A service may provide an additional collection notice where particular information is requested. External platforms also have their own privacy practices.
11. Australian Consumer Law And Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
Otherwise, to the extent permitted by law, we are not liable for indirect or consequential loss arising from use of, inability to use, or reliance on a website, online feature or automated output. Any limitation is applied only to the extent it is lawful and reasonable in the circumstances.
12. Changes, Severability And Governing Law
We may update these terms as our services, providers or applicable law change. The current version and update date will be published on our websites. Updated terms apply to later website use and new or renewed services; they do not retrospectively replace an accepted fixed-scope agreement unless agreed or required by law.
If part of these terms is invalid or unenforceable, the remaining provisions continue to apply. These terms are governed by the laws of Queensland, Australia, and disputes are subject to the non-exclusive jurisdiction of the courts of Queensland.
Schedule A — Suburban Australia
This schedule applies to suburbanau.com, general group enquiries and services offered directly as Suburban Australia. The site explains the group and may receive general technology, recycling or business enquiries. A submission does not create an obligation to accept equipment or provide a service.
Recycling, data destruction and other operational work will be confirmed separately. Unless a certified destruction service is agreed, customers should remove or back up sensitive data where practical before handing over equipment.
Schedule B — Suburban Secure
This schedule applies to Suburban Secure advisory, cyber security, infrastructure, implementation and related professional services. Website guidance is general; paid work is limited to the scope, systems, evidence, assumptions and access stated in the accepted proposal or quote.
You remain responsible for business decisions, authorising changes, identifying legitimate users and services, and providing timely access and information. We will distinguish recommendations from changes we have been authorised to implement. A security review or implementation reduces identified risks but does not transfer responsibility for operating your organisation or guarantee future security.
Schedule C — Townsville Computer Man
This schedule applies to device repairs, support, collection and return, recycling, data services and secondhand sales. A booking is not a fixed-price repair agreement. We assess the device and provide or confirm a quote before paid work starts; you may decline before approval, subject only to any diagnostic fee agreed in advance.
Free collection and return covers transport within the stated Townsville service area, not the repair itself. Times are arranged around reasonable availability. Please back up important data where practical. We take reasonable care but cannot guarantee recovery or preservation of data affected by a pre-existing fault, failing storage, malware, liquid damage or work you have authorised.
Some faults cannot be economically or technically repaired. If work cannot be completed, we will explain the outcome and charge only amounts properly agreed for diagnosis, parts or work already authorised. Third-party parts and software retain their applicable supplier or manufacturer terms, in addition to rights that cannot be excluded.
Devices should be collected or accepted for return within a reasonable period after notification. Any storage charge or further arrangement must be communicated and agreed where required by law. Secondhand-product returns and refunds are also governed by the Townsville Computer Man Refund Policy and the Australian Consumer Law.
Schedule D — Can They Email As Me?
This schedule applies to cantheyemailasme.com, its public domain checker, private result links, accounts, verified domains, monitoring, alerts, DMARC reporting and subscription features. The checker reads public signals and does not access a mailbox, private network or domain-control panel.
Results and candidate DNS records are point-in-time automated guidance. Public DNS, resolvers, mail servers, blocklists and networks can be incomplete, delayed or unavailable. Before changing SPF, DKIM or DMARC, confirm every legitimate sender and preserve rollback information; incorrect changes can interrupt legitimate email.
Anyone with a private result link can view it, so you are responsible for sharing it carefully. Domain verification is required before ownership-dependent monitoring, reporting or remediation features are used. The Can They Email As Me? Acceptable Use Policy forms part of this schedule.
Plan limits and prices are those shown at checkout. Paid subscriptions, when available, are processed by Stripe and may renew until cancelled. We do not guarantee scan completion, monitoring frequency, permanent result retention or delivery of every alert.
